1. General

Following general trading conditions apply to all contracts, supplies and other achievements. We contradict deviating regulations of the contracting party hereby expressly. All special agreements require the written confirmation on our part. Erich Alfranseder is at any time entitled to change or supplement these general trading conditions including all possible plants with an appropriate term of notice. Detailed orders are worked on before after the then still valid old general trading conditions.

2. Offers and prices
Our offers are noncommittal. Small deviations and technical changes to our illustrations or descriptions are possible. As far as nothing different one is agreed upon, the prices specified in the order apply all indicated prices are up to the time valid at which we new prices to publish. The prices include value added tax plus overall forwarding expenses proven in the order. In the case of supplies into a country, which is not member of the European Union, the price reduces itself around the German value added tax. The buyer has to carry the tariffs and import value added tax developing with the import directly in this case however. It exempts us in this connection from each demand.

3. Supply and payment
The terms of payment and supply are more near proven in the purchase order form. In accordance with remote paragraph law the buyer with delivery of its order a legal sales contract is received.

4. Supplies, higher force
Dates and times for delivery mentioned by us are noncommittal, if not expressly something else was agreed upon. The time for delivery extends, without we refer to separately if and as far as the buyer selected payment means "first transfer", but no payment carries out. Temporary delivery obstacles due to higher force (e.g. war, natural catastrophes, trade restrictions, strike, obstructions of traffic) and other unvorsehbarer and events representing of us not entitle us to only implement the supply after removal of this obstacle. If the obstacle exists over more than two months beyond our regular times for delivery, both we and the buyer are entitled to withdraw under appropriate period setting from the contract.

5. Return right

Used devices and/or specially in the desired format provided articles are excluded from the conversion.

6. Payment and passage of the risk
Our calculations are depending upon agreement by first transfer or by cash on delivery (starting from the 2. order also by transfer after receipt of the commodity) and/or during collection bar payable, as far as differently does not agree. Supplies abroad take place only against first transfer

Unsere Rechnungen sind je nach Vereinbarung per Vorauskasse oder per Nachnahme (ab der 2. Bestellung auch durch Überweisung nach Erhalt der Ware) bzw. bei Abholung bar zahlbar, soweit nicht anders vereinbart. Lieferungen ins Ausland erfolgen nur gegen Vorauskasse.

In the case of the first transfer the payment is to be made within two weeks after entrance of our confirmation of the order entrance. The time of the receipt is relevant with us. During later payment we will inform the buyer immediately, if we don't accept his order (e.g. because of intermediate price increases), and which paid amount back transfer. The same applies to that extent, when we accept an order also with payment within the prescribed period only partly or not at all. A payment is considered only then as effected if we can have the amount

7. Guarantee
Erich Alfranseder ensures that the sold commodity is free of the risk of errors at the time of the passage and has the contractually assured characteristics. With arrival the customer has to examine the commodity immediately on lack and condition. In the case of open lack these must be announced within 3 days after discovery in writing to us, equally hid lack. With complaints the purchase date with a calculation must be proven. Unfreely and without previous announcement sent back commodity is not accepted in principle. The guarantee expires, if the customer changes the supplied commodity. The guarantee period amounts to 24 months starting from delivery of the commodity.
No guarantee resulted are assumed for damage, from unsuitable or inappropriate use, incorrect assembly and/or initial start-up by the buyer or third, natural wear, incorrect or careless treatment, unsuitable operational funds, neglect of the operating and instructions as well as inappropriate changes or repairs from the buyer or third. If the commodity is continued using despite knowledge of a lack, then we are responsible only for the original lack, not however for such damage, which resulted from the further use.

8. Property reservation
Up to the complete payment the commodity remains property of the company Erich Alfranseder, special devices for beekeepers.

9. Data storage
In accordance with § 28 of the Federal Law for Data Protection (BDSG) we make attentive to the fact that in the context of the business complete the necessary data are processed and stored by means of an EDP system in accordance with § 33 (BDSG). personal data are naturally confidentially treated and are not passed on.

10. Area of jurisdiction
Place of delivery and area of jurisdiction for both parts is the seat of the company Erich Alfranseder, special devices for beekeepers.
